NEW DELHI : The government has decided to grant special amnesty to certain types of prisoners as part of the ‘Azadi ka’ celebrations. Amrit Mahotsav‘ to mark the 75th anniversary of India’s Independence Day.
Those sentenced to prison who meet the conditions of release under this program will be released on three days – August 15, 2022; January 26, 2023; and August 15, 2023, the Department of the Interior includes all states and Union territory in a communication dated June 10.
Follow MHA instructing, inmates eligible for special amnesty, including women and transgender people aged 50 and over; male prisoners aged 60 years or older; 70% or more physically disabled and juvenile offenders between 18 and 21 years of age with no involvement in any other crime. However, all prisoners in these categories should have completed 50% of the total sentence time to be eligible for release.
Other people eligible under this special remission program include those with a terminal illness (validly certified by the medical board); inmates have completed two-thirds of the total serving time; and poor or poor prisoners who have finished serving their sentences but are still in prison for not paying fines (no fines).
The MHA guidelines also include a complete list of convicted prisoners who are not eligible for special parole. These include persons sentenced to death, including those in which the death sentence has been reduced to life in prison or those convicted of crimes for which death has been designated as one of the punishments. punish. Other exceptions are convicts serving a life sentence; those convicted in cases related to terrorism or under the Explosives Act, NSA, OSA and the Anti-Robbery, Crimes Against the State, Forgery, Rape, Trafficking, the Pocso Act, PMLAFEMA, the NDPS Act and the Anti-Corruption Act.
Under the process, states and UT would have to form a state-level screening committee headed by the home affairs officer to review eligible inmate cases. The list proposed by the committee will be sent to the state government for approval before being sent to the governor for consideration under Article 161 of the Constitution. The MHA shares a schedule for each of the three release phases with the states and UT.
To facilitate the selection process of eligible prisoners and periodically update their status online, a new ‘special remission’ module has been added to the e-Prisons software.
Cases where the Center’s approval is required by law will be sent to the Ministry of Home Affairs while the release of foreign nationals prisoners will require the consent of Foreign Office.
Prior to the release of prisoners, counseling sessions can be held for them and their loved ones to facilitate their rehabilitation in society, the Department of the Interior instructed states and UTs.
