Biden announces two new circuit court picks in first-year sprint to fill trial loopholes



Biden selected Andre B. Mathis as his nominee to serve on the 6th U.S. Circuit Court of Appeals, the official said. Judge Alison J. Nathan will be nominated to serve on the 2nd Circuit of U.S. Court of Appeals. Nathan is currently presiding over the criminal trial of former Jeffrey Epstein associate, Ghislaine Maxwell.

The selections mark the latest attempt to fill the loopholes of the key appellate court, seen as critically important in efforts to form the second-highest courts in the country. Biden’s two latest picks will bring the total number of candidates nominated in the circuit so far to 16.

Biden and Senate Majority Leader Chuck Schumer quickly filled in the loopholes across the federal judiciary that have been at the heart of the first 10 months of Democrats’ control of the White House and Senate, and have secured the endorsement of 9 district judges and 19 district judges. Biden’s latest picks will mark the 63rd and 64th judicial nominees in his first year in office.

Schumer made it clear to his members that floor time for votes on Biden’s nominees is critical, and Senate Judiciary Chairman Richard Durbin, a Democrat Illinois, has made the processing and promotion of nominations a central part of his committee’s work.

Biden served as chairman of the Judiciary Committee during his 36 years in the Senate.

“President Biden has spent decades committed to strengthening the federal bench, which is why he continues to move quickly to fill judicial vacancies,” the official said.

The pace of the effort – and the focus Biden’s team has placed on quickly identifying, naming and sending candidates to Capitol Hill – comes as Democrats both inside and outside government have moved put a new focus on the issue after the former President’s rise. Donald Trump’s sweeping effort to endorse more than 230 federal judges during his time in office.

Trump’s success marked a foundational achievement for then-Senate Majority Leader Mitch McConnell, a Kentucky Republican, and raised the issue among Democrats, who witnessed it. saw the balance of courts from the Supreme Court reshaped in the face of Trump’s 2020 election defeat.

Mathis, who currently practices privately at Butler Snow LLP, will become the first black person to serve on the 6th Circuit in 24 years if confirmed.

Nathan, now a judge for the Southern District of New York, will become the second LGBT woman to serve in any federal court. The first, Beth Robinson, was also nominated by Biden to serve on Track #2. She was confirmed by the Senate earlier this month.

Nathan addressed the potential selection Wednesday, ensuring that she will continue to oversee the Maxwell case regardless of any potential nominations.

“Needless to say, I’m honored, but let me be clear: If I am nominated, I, like every other district judge who has been considered for promotion, will continue to do his day job. I mean presiding over this trial, said Nathan.

Maxwell is charged by New York federal prosecutors with conspiring and luring a minor to travel to commit illegal sexual acts and transporting a minor to engage in criminal sex activity. charged with grooming and recruiting underage girls between 1994 and 1997. The trial featured a jury of choice.

In total, 73% of Biden’s judicial picks to date have been women and 27% are African-American.
