Lululemon declares Peloton a ‘copycat’
The Canadian sportswear maker sued Peloton in Los Angeles federal court, seeking triple damages because it was alleged by a competitor to “intentionally” infringe six design patents.
Peloton and its attorneys did not immediately respond to requests for comment.
Lululemon said five Peloton women’s bras and leggings – Strappy Bra, High Neck Bra, Cadent Peak Bra, Cadent Laser Dot Bra and Cadent Laser Dot Leggings – infringed its patents.
It also said another Peloton product, the One Lux Tight, was a clone of Align pants, one of the company’s all-time best-selling products.
Peloton “intends to closely copy Lululemon’s exclusive designs and treat its merchandise as high-quality Lululemon products in order to appropriate the great goodwill that Lululemon has spent so much time, effort and money on.” costs to cultivate,” Lululemon said in the complaint.
The Vancouver, British Columbia-based company, in a letter to Peloton on November 11, threatened to sue unless sales of the alleged counterfeits were suspended.
Peloton asserts in its lawsuit that customers should have no difficulty distinguishing the company’s products and that Lululemon’s designs are not distinctive enough to warrant patent protection.
The cases are Lululemon Athletica Canada Inc v Peloton Interactive Inc, United States District Court, Central District of California, number 21-09252; and Peloton Interactive Inc v Lululemon Athletica Canada Inc, United States District Court, Southern District of New York, no. 21-10071.
