Oppo suffered a serious legal impediment in Germany. According to a report on Nokiamob.net, the Mannheim District Court ruled in favor of Nokia against a recent patent dispute with Oppo. The court made this ruling in Nokia’s two lawsuits against Oppo and OnePlus. Finland-based Nokia sued Oppo in four different countries in 2021 after failing to reach an agreement with the Chinese smartphone giant. This currently prohibits the two brands from selling their devices in Germany.

No. Nokia has won its first patent dispute against Oppo. However, it is the first judgment in battles. For now, Oppo and its sister brand OnePlus can no longer sell mobile devices in Germany that infringe Nokia’s European patent EP 17 04 731.
What is the lawsuit about?
The patent is said to protect the technology of scanning WiFi connections. In July 2021, Nokia filed several patent infringement lawsuits against Oppo in several countries in Asia and Europe, including India, UK, France, and Germany. The lawsuit accuses Oppo of using patented Nokia technology without a valid license in its devices. As reported on CNBC, the lawsuit claims that Oppo is using Nokia’s essential standards (SEP) and non-SEP patents such as UI/UX and security features without a license. The lawsuit was filed after a previous patent licensing agreement between the two companies was not renewed. Oppo and Nokia signed an agreement in November 2018 that expires in June 2021.

Nokia said that Oppo rejected its “fair and reasonable” proposal. “We negotiated renewal of our patent license agreement with OPPO, but unfortunately, they rejected our fair and reasonable offers. Litigation is always our last resort and we have offered to engage in independent and neutral arbitration to resolve the matter amicably. according to Nokiamob.

Responding to the lawsuit, Oppo said, “OPPO respects and protects its own and third-party intellectual property rights, and is committed to healthy patent licensing cooperation in the industry. OPPO opposes such practices. unreasonable consultation as using litigation as a tool.” Just a few months after Nokia’s lawsuit (September 2021 to be exact), Oppo has filed a number of patent infringement lawsuits against the company in China and Europe. These patents relate to all 5G standard essential patents.

Oppo is not the first company Nokia has sued. In May 2017, Apple paid Nokia $2 billion to settle a patent lawsuit. Nokia has accused Apple of infringing on a number of Nokia patents as well as those of NSN and Alcatel-Lucent, which Nokia owns. However, the two companies quickly resolved the dispute and are now collaborating on several technologies. Nokia has also filed patent infringement lawsuits against Lenovo in the US, Brazil, India and Germany. This lasted for almost a year and was finally resolved by the two companies in April 2022.
