Update #2 [Mon 29th May, 2023 03:30 BST]:

A Nintendo spokesperson provided a Official statement with Kotaku About the DMCA for Dolphin’s Steam page:

“Nintendo is committed to protecting the hard work and creativity of video game engineers and developers. This emulator illegally circumvents Nintendo’s protections and runs illegal copies of games. Using illegal emulators or illegal copies of games harms development and ultimately stifles innovation. Nintendo respects the intellectual property rights of other companies and, in turn, expects others to do the same.”

Update number 1 [Sat 27th May, 2023 13:45 BST]:

Dataminer and Nintendo Life users LuigiBlood highlighted part of the DMCA – revealing the Wii’s Public Key resides in the Dolphin Emulator source code.

LuigiBlood: “DMCA quote: “the Dolphin emulator works by combining these cryptographic keys without Nintendo’s permission and decrypting the ROM at or just before runtime.” …this is true one objectively. I just checked, the Wii Public Key is in the code emulator source.”

Game developer MVG also shared his own situation summary based on this information and even found evidence (dating from 2020) of an individual named ‘Littlemac123’ alerting others to “code that copyright from the Wii system” in the Dolphin Emulator and the problems it could cause if it was released on Steam.

MVG: You can still download Dolphin by other means… but I’m a bit concerned. I’ll be honest with you, Nintendo is on fire right now because they’ve found these keys, and they obviously spent a lot of time going through the Dolphin Source Code almost line by line, figuring out the key areas. trouble areas, especially where illegal things or keys of this kind really shouldn’t be there…”

“…’Littlemac123′ is back in 2020, you’ve got your pulse here… unfortunately Dolphin won’t be joining Steam and hopefully that will change… on this particular version, I’m not going to say that Nintendo is at fault… but Dolphin screwed this up and they really need to address that and hopefully they will.”

Original article [Sat 27th May, 2023 04:05 BST]:

Back in March, the team behind the GameCube and Wii Dolphin emulators Announced release on Valve’s Steam service.

In an update on Today’s Dolphin Page, it was revealed that Nintendo had issued a DMCA to Dolphin’s Steam page. The release, scheduled for “Q2 2023”, has now been “delayed indefinitely”.

Here is the full statement from the development team, mentioning how they are “currently investigating” their options:

“It is with great disappointment that we have to announce that the release of Dolphin on Steam has been postponed indefinitely. Valve has informed us that Nintendo has issued a DMCA against Dolphin’s Steam page and has removed Dolphin from Steam for until the matter is resolved. We are currently investigating our options and will have a more in-depth response in the near future. We appreciate your patience in the meantime.”

In Dolphin’s Steam description, it was noted how “the app does not come with the game” and would require players to “own an original copy of any game”. The Steam emulator release also promises 4K monitor support, modern controllers, multiplayer, completely open source, and a “free” download.

Other emulators already exist on Steam, like RetroArch – so there could still be a chance for Dolphin to be released on Valve’s service in some way or form in the near future.
