However, the Justice Department told the court that the family members were not victims of the crime. Department lawyers also said the settlement includes compensation above what the law requires.

Last month, several relatives of the passengers held a video conference with Garland in which they asked the attorney general to help them reopen the agreement, which was reached two weeks before the Trump administration left office.

According to meeting participants, Garland expressed sympathy for the passenger’s relatives but did not express a view on the incident.

In the settlement, Boeing blamed two former test pilots for misleading the Federal Aviation Administration about a key flight control system that played a role in two crashes in Indonesia and Ethiopia that killed 346 people. people killed. The Justice Department has agreed not to prosecute Boeing for conspiring to defraud the government.

The bulk of the payment, about $1.8 billion, went to airlines that lost money because their Max planes were out of service for nearly two years. Boeing agreed to pay a fine of $243.6 million and contribute $500 million to a fund for relatives of the victim.

The company has settled many, but not all, of the family lawsuits.
