In 10 states, millions of Americans are voting in person on abortion access
Nebraska prohibits abortion at 12 weeks, with specified exceptions for rape, incest or “to avoid her death or to avoid serious danger of physical deterioration significant and irreversible loss of a major bodily function”.
Nevada
Nevada Question 6, titled Abortion rights initiativewould establish a state constitutional right to abortion, while allowing the government to administer it after the point of “fetal viability,” about 24 weeks. The initiative includes exceptions intended to “protect the life or health of pregnant patients.”
In Nevada, abortion is currently legal. The ballot initiative would further ensure these protections.
New York
In New York, Proposition 1, or the Equal Protection Act Amendment, would add a clause into the state Bill of Rights, which guarantees “against unequal treatment based on ethnicity, national origin, age, disability, and sex, including sexual orientation, gender identity, and pregnancy”.
The initiative would also add protections “against unequal treatment based on autonomy and reproductive health care.”
In the Empire State, abortion is legal up to and including 24 weeks. After that point, there are exceptions for fetal viability or to protect the life or health of the pregnant person. Providers cannot be criminally prosecuted for performing abortions outside this window, and minors do not need parental permission for birth control, abortion, prenatal care, or access other reproductive health care services.
Across what is considered a deep blue state, the ballot initiative has been overrun by anti-trans activists seeking to prevent the amendment from turning into a referendum on parental rights.

South Dakota
